Fireworks at home
Florida law lets people use consumer fireworks on three designated holidays: New Year’s Day, Independence Day (July 4) and New Year’s Eve, under section 791.08 of the Florida Statutes. The law does not override local rules, and a homeowners’ association covenant that is properly recorded can still ban them. An HOA board cannot make a new rule taking the right away, the statute says.
Safety basics:
- Light fireworks outdoors, on a hard surface, away from homes, dry grass and parked cars.
- Keep a bucket of water or a hose nearby, and soak used fireworks before throwing them away.
- Never let children light fireworks, and never relight a dud.
- Fireworks frighten pets and horses. Keep animals inside or secured.
